USER AGREEMENT

Introduction

This User Agreement (“Agreement”) governs your relationship with MarketMosaicPro (“the Service”).
By creating an account, accessing the dashboard, or using any features within the Service, you acknowledge and accept the terms of this Agreement in full.

This Agreement is intended to complement, not replace, the Terms & Conditions, Privacy Policy, and Acceptable Use Policy.

Eligibility

To use the Service, you must:
• Be at least 16 years old
• Provide accurate registration information
• Have the legal authority to enter into agreements on behalf of your business (if applicable)

Use of the Service by minors is prohibited.

User Account Responsibilities

Users agree to:
• Maintain the confidentiality of login credentials
• Prevent unauthorized access to their account
• Keep contact and billing information accurate
• Immediately report suspicious activity

You are responsible for all actions taken under your account.

H3 — Lawful Use of the Service

You agree to use MarketMosaicPro solely for lawful, ethical business purposes.

You may not use the Service to:
• Store data obtained without consent
• Send unsolicited or unlawful communications
• Harass, defraud, or mislead others
• Upload malicious files or harmful code
• Infringe intellectual property rights
• Commit or facilitate illegal activity

Violation of these rules may result in termination of your account.

Client Data & Consent Requirements

Because the Service allows you to store information about your own clients, you must:

• Obtain lawful consent prior to storing personal data
• Maintain records of consent for email and communication purposes
• Only store information you are legally permitted to collect
• Comply with global privacy and anti-spam laws

Users bear full responsibility for the personal data they upload.

Applicable regulations include:
• GDPR (European Union)
• CASL (Canada)
• CAN-SPAM (United States)
• CCPA/CPRA (California, where applicable)
• Other regional privacy laws

Communication & Email Marketing Rules

When sending email or newsletters through the Service, you must:

• Have explicit consent from each recipient
• Identify yourself accurately
• Include valid contact information
• Honor unsubscribe requests promptly
• Avoid deceptive headers or subject lines

Non-compliance may result in account suspension or termination.

Content You Upload

Users may upload notes, tasks, files, communications, and business-related content.
You warrant that any uploaded content:

• Does not violate copyright
• Is not illegal, harmful, or abusive
• Is free of viruses or malicious code
• Does not infringe the rights of any third party

We reserve the right to remove content that violates this Agreement.

Service Modifications & Feature Changes

MarketMosaicPro Software Inc. provides a secure CRM and marketing automation platform known as MarketMosaicPro for REALTORS®, consultants, and service-based businesses. Learn more about our platform features or pricing. We may update, modify, or discontinue specific features at any time. These changes may occur without prior notice, although we aim to communicate major adjustments when possible.

Users acknowledge that software evolution is a normal and necessary part of the Service.

Account Suspension or Termination

Your account may be suspended or terminated if:

• You violate this Agreement
• Your actions jeopardize system security
• You misuse client data
• You breach email communication laws
• You engage in fraudulent or unlawful activity

You may also voluntarily terminate your account at any time.

Data Handling After Termination

If your account is terminated:

• Access to the platform is revoked immediately
• Data may be deleted according to our Retention & Destruction Policy
• Backups may retain temporary copies before automated purge

We encourage users to export important information prior to account closure.

Limitation of Liability

To the fullest extent permitted by law, MarketMosaicPro is not liable for:

• Indirect or consequential damages
• Loss of income, data, or business opportunity
• Errors, outages, or service interruptions
• Unauthorized access resulting from user negligence

Your use of the Service is at your own risk.

Amendments to This Agreement

This Agreement may be updated periodically.
Updated versions become effective upon posting to this page.
Continued use of the Service constitutes acceptance of any changes.
